These Terms of Service govern access to thecircabeauty.shop and purchases from RAYORA INTERNATIONAL LIMITED, a company incorporated in Hong Kong with limited liability and trading as Circa Beauty. By using the website or placing an order, you agree to these Terms, our Privacy Policy, Shipping Policy, and Return and Refund Policy. If mandatory consumer law gives you rights that conflict with these Terms, the mandatory law prevails.

1 Eligibility and account responsibilities

You must have legal capacity to enter into a contract in your jurisdiction or use the website with the involvement of a parent or legal guardian where required. You are responsible for the accuracy of information submitted, for safeguarding account credentials, and for activity carried out through your account. Notify us promptly if you suspect unauthorised use.

2 Products and handmade variation

We take reasonable care to describe and photograph products accurately. Screen settings, lighting, handmade production, and natural variations in decorative materials may cause minor differences in colour, placement, pattern, finish, or dimensions. Such minor differences do not affect your rights if goods are defective, unsafe, materially misdescribed, or do not meet mandatory legal standards.

Product availability is not guaranteed. We may limit quantities, discontinue products, or correct genuine listing errors. If an ordered item is unavailable or a material listing error affects the order, we will contact you and provide an appropriate option, including cancellation and refund where required.

3 Sizing and product selection

Please review the size chart, shape, length, colour, and product contents before ordering. Sizing guidance is approximate because natural nails differ. A wrong size selected by the customer is normally treated as a change-of-mind return, subject to the Return and Refund Policy and mandatory consumer rights.

4 Safe use

Press-on nails and related accessories are cosmetic products for external use. Circa Beauty sets include adhesive tabs and do not include nail glue. Read and follow all product and adhesive-tab instructions. Do not apply a product to damaged, infected, inflamed, or irritated nails or skin. Keep adhesive tabs and other small accessories away from children. Stop use if irritation or an adverse reaction occurs and seek appropriate medical advice if needed. Product information on the website is general and is not medical advice.

5 Orders and contract formation

An order is an offer to purchase. An automated order acknowledgement confirms receipt but does not necessarily constitute acceptance. A contract is formed when we accept the order by dispatching it or otherwise expressly confirming acceptance. We may reject or cancel an order for legitimate reasons, including suspected fraud, payment failure, pricing or stock error, legal restriction, or inability to deliver. If we cancel after payment, we will refund the amount collected for the cancelled item or order.

6 Prices payment and taxes

Prices are shown in USD unless another currency is selected or displayed at checkout. The final price, available discounts, shipping charge, and any taxes collected by us are shown before the order is submitted. Currency conversion and bank charges may be imposed by your payment provider. We may change future prices and promotions, but a change will not alter an order already accepted except where the law permits correction of an obvious error and an appropriate remedy is offered.

7 Promotions

Promotions are subject to the terms displayed with the offer, including dates, qualifying products, order thresholds, and exclusions. Unless stated otherwise, promotions cannot be combined, have no cash value, and apply while available. We will not use a promotion in a way that misrepresents the actual price, availability, or benefit.

8 Shipping returns and refunds

Processing, delivery, customs, cancellation, returns, hygiene restrictions, and refunds are governed by our Shipping Policy and Return and Refund Policy, which form part of these Terms.

9 Reviews photographs and other submissions

If you submit a review, photograph, video, or other content, you confirm that it is accurate, lawful, and yours to submit. You grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce, format, and use that content in connection with the store and its marketing, subject to applicable privacy law and any separate permission we request. We may remove unlawful, misleading, abusive, infringing, or irrelevant content, but we will not suppress a genuine negative review merely because it is unfavourable.

10 Intellectual property

The website and its text, photographs, graphics, logos, product presentation, and other content are owned by us or used under licence and are protected by applicable intellectual-property laws. You may use the website for personal, non-commercial shopping. You may not copy, scrape, reproduce, modify, distribute, sell, or exploit protected content without permission, except as allowed by law.

11 Prohibited use

You must not use the website to commit fraud or another unlawful act, interfere with security or operation, introduce malicious code, collect data without authority, impersonate another person, infringe rights, submit false claims, or evade purchase limits. We may suspend access or cancel affected orders where reasonably necessary to protect the website, customers, or our legal rights.

12 Third party services

The website may use or link to third-party payment, social-media, delivery, or other services. Those services may be governed by separate terms and privacy notices. We are not responsible for an independent third party's acts or content, but this clause does not exclude responsibility that applicable law places on us for performing your order.

13 Disclaimers and limitation of liability

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence where such liability cannot lawfully be excluded, breach of mandatory statutory obligations, or any other liability or consumer remedy that cannot lawfully be excluded or limited.

Subject to the preceding paragraph and to applicable law, we are not liable for indirect or consequential loss that was not reasonably foreseeable when the contract was made, or for loss caused by misuse, unauthorised alteration, failure to follow instructions, or an event outside our reasonable control. Any limitation will apply only to the extent it is lawful, fair, and reasonable in the circumstances.

14 Governing law and disputes

These Terms and any non-contractual dispute are governed by the laws of the Hong Kong Special Administrative Region. The courts of Hong Kong have non-exclusive jurisdiction. If you are a consumer, this clause does not deprive you of mandatory protections or a right to bring a claim in another forum that cannot lawfully be waived under the law applicable to you.

15 Changes severability and waiver

We may update these Terms for future use of the website or future purchases. The version in effect when an order is accepted will govern that order unless a change is required by law or agreed with you. If a provision is held invalid or unenforceable, the remaining provisions continue to apply. A failure to enforce a provision on one occasion is not a waiver of the right to enforce it later.
